Notes for Amazon Sellers: What should you pay attention to when selling things on Amazon?

Before you can start selling on an Amazon marketplace site in a country other than your location, you need to provide a bank account in a country supported by Amazon for payment. Additionally, you should be aware of the laws that apply to you as a seller on the Site and should only list and sell products that comply with those laws. You should consult with legal and tax advisors who understand these requirements that may apply to you to ensure that the products you offer on the Amazon Marketplace Site are:

You are licensed to sell

You are able to deliver to the buyer on time (meeting the buyer's expectations every time), and

You are able to provide after-sales support.

Please confirm that you have consulted your legal and tax experts (as you deem necessary) and carefully considered the conditions set out below. You agree to offer Products on the Amazon Site only if all of the following conditions are met.

The following applies to all products that you offer, promote, and sell on the Amazon Marketplace website:

Buyer expectations. You will provide buyers with accurate information about the origin of the products. You need to provide an accurate shipping address in your seller profile and manage buyer expectations by stating actual delivery times to your location. You are responsible for delivering all orders within the promised delivery time.

Delivered to the buyer. You must use reliable shipping methods so that customers receive their purchases on time, every time. Don't subject your buyers to customs delays or additional duties and taxes on their items. You are responsible for complying with all import and export obligations and paying all applicable duties and customs fees. In short, customers must receive their ordered merchandise in good condition, without any additional charges or fees, within the estimated delivery date that you publish on your Amazon marketplace site.

Customer service. You must be prepared to respond quickly to questions from your customer contacts in the language of the applicable Amazon marketplace site (the site where you are registered to sell products). When buyers have questions or concerns about your products, they expect you to provide timely and helpful service. You should have customer service professionals who (i) understand your products, (ii) know where customers' purchased products are and when they will arrive, and (iii) are able to respond quickly (and in any case within 24 hours) to contact emails from customers in the language of the applicable Amazon marketplace site where you have registered to sell your products.

Note: If you provide telephone support, you will be required to provide it in the language of the selected country and during business hours in that country's time zone.

When you interact with Amazon Customer Service or Seller Support, you will need to communicate in the language of the applicable Amazon marketplace site (the site where you registered to sell products).

Selling rights. You must obtain permission to offer, promote and sell products on this website. The laws vary from country to country (and even within countries). As a seller of products, you are responsible for ensuring that your products are not offered to buyers unless you have confirmed that you can sell and ship the products to all potential buyers in accordance with all applicable laws.

For example, you should confirm that:

Applicable import and export laws permit the shipment of the Goods to each potential buyer,

Your products meet local consumer protection requirements, product compliance requirements, and environmental regulations. For example, products should comply with local age restrictions, usability requirements (e.g., have supporting product documentation in the local language), product safety requirements and certifications (e.g., comply with all hazardous material restrictions, including product labeling requirements), and

The sale and distribution of the products do not violate the intellectual property rights of others (such as the manufacturer of the products).

Product information. You will list your products in the primary language and currency of the applicable Amazon marketplace site (the site where you are registered to sell products).

Buyer charges. Your product listings will include all applicable charges and taxes (including VAT, customs duties, excise taxes, etc., as applicable). You shall provide VAT invoices to buyers upon request, where applicable.

return the goods. You must abide by our Return Policy. You will either (i) provide the buyer with a local return address within the applicable Elected Country (eg, if you list products on Amazon.co.jp, the local return address must be within Japan), or (ii) pay for the return shipping costs for products returned to an international address. This may take the form of a prepaid return label or reimbursement for return shipping costs incurred by the buyer.

If you use a freight forwarder or other third-party service to ship return shipments from the return address to another location, you are required to receive the return and process the refund promptly after the return arrives at the return address you provided to the customer. Once the package is delivered to the return address you provide, the buyer is not responsible for any problems that occur while in transit.

If Amazon determines, in its sole discretion, that you have failed to provide a local return address and have not paid or reimbursed the customer for return shipping costs to an international address, any applicable return shipping expenses may be refunded to the customer, and you will promptly reimburse Amazon for those expenses in accordance with the terms of your Seller Agreement.

Taxes and fees. You are solely responsible for (i) determining whether any Taxes are due, (ii) paying all applicable Taxes, and (iii) completing state reporting with the appropriate taxing agencies. You are responsible for complying with all applicable GST/VAT obligations, including GST/VAT obligations for the Elected Country, the country to which the Products are shipped, and any other applicable countries.

Your sales agreement. You are always subject to the terms and conditions of the sales agreement.

Important reminder of your obligations when using Fulfillment by Amazon

Before you start using Fulfillment by Amazon in selected countries outside of your location, you will need to provide a bank account in a country supported by Amazon for payment. Additionally, please discuss the following carefully with your legal and tax experts (as you deem necessary) and only participate in Fulfillment by Amazon if you comply with all of the following requirements:

Stock delivery.

If you choose to send inventory directly to Amazon from outside the Selected Countries, you must use an import broker (either selected by you or assigned by Amazon). All inventory sent directly to Amazon from outside the Selected Countries must be sent under “Delivery Duty Paid” shipping terms and subject to payment of all applicable import duties and taxes. Amazon is not responsible for any import duties, taxes, shipping charges, or miscellaneous charges associated with importing into selected countries.

Performance bond.

If you choose to send inventory directly to Amazon from outside of the Selected Countries, you will be required to obtain an Import Fulfillment Bond.

Importer and consignee.

If you choose to send inventory directly to Amazon from outside of the Selected Countries, you will need to list yourself as the importer and consignee, not Amazon, and you will also need to register as a non-resident importer if necessary. Amazon will not act as the consignee importer for this inventory.

Return shipping address.

Amazon is currently unable to return FBA inventory to addresses outside of the Selected Countries. Additionally, Fulfillment by Amazon does not currently support the option for sellers to pick up their packages at Amazon fulfillment centers. If you would like stock returned to you, you must provide an address within the selected country.

Taxes and fees.

If you have inventory in a Selected Country, you may be responsible for certain taxes within that Selected Country.
